Navigating the EHCP Process: A Guide for Parents


When I thought about what picture to put here to best describe trying to secure an EHCP, a mountain came to mind and then my daughter who is a climber. The mountain analogy can work two-fold, trying to obtain an EHCP and your SEND child trying to get through education and life can both feel like climbing mount Everest. I remember so clearly when I spoke to my sister about what I was going to saying in my closing speech to the judge, she said, well it's like her trying to climb a mountain in flipflops! This has always stayed with me, yes I couldn't put it better, how can she get to the top without the correct resources/equipment and support? She could get a very limited way with flipflops, with greater risks of injury and pain but never to the top. And this summed up exactly why I had to fight to get support for my daughter and what kept me going. I knew I had to fight to get her the EHCP she needs, to get her those mountain boots and enable her the best possible chance to reach the summit and achieve her full potential. For most families, it is an arduous journey, had I known what I know now, my journey would have been easier with less obstacles and set backs. Now I want to use my lived experience to help families facing the same challenge.

The EHCP (Education, Health and Care Plan) process is an overwhelming and confusing process for parents and carers of children with SEND. First and foremost, it's important to understand the significance of the EHCP. This plan is designed to provide a tailored and holistic approach to meeting the unique needs of individuals with special educational needs. To begin the EHCP process, you will need to make an initial request to your local authority. This can be done by writing a letter outlining your concerns and the support you believe your child requires. It's essential to provide as much evidence as possible, including reports from professionals and any assessments that have been conducted. This will help to strengthen your case and ensure that your child's needs are accurately assessed. Once your request has been received, the local authority will conduct an assessment to determine whether your child is eligible for an EHCP. This assessment will involve gathering information from various professionals, such as teachers, doctors, and therapists, who work with your child. It's important to actively participate in this process by attending meetings and providing additional information or evidence if required.


Should your LA refuse to carry out an EHC needs assessment, you need to appeal to the SEND Tribunal.


After the assessment, a decision will be made regarding whether your child is eligible for an EHCP. If they are, the next step is to develop the plan itself. This will involve working closely with professionals, including the local authority, school, and any other relevant parties. It's crucial to actively engage in this process, ensuring that your child's needs are accurately reflected in the plan and that the necessary support and provisions are included.


Should your LA refuse to issue an EHCP, you need to appeal to the SEND Tribunal.


Once the EHCP is in place, it's important to regularly review and monitor its effectiveness. This will involve attending review meetings and providing feedback on your child's progress and any changes that may be required. It's essential to maintain open and effective communication with all professionals involved, advocating for your child's specific needs and ensuring that the plan is continuously meeting their requirements.


Should your LA refuse to amend an EHCP, you need to appeal to the SEND Tribunal.


Throughout the EHCP process, it's natural to have concerns and face challenges. It's important to remember that you are your child's best advocate. Be proactive in seeking information, asking questions, and seeking support from professionals and support groups. Remember that you have the right to challenge decisions and request changes if you believe they are not in the best interest of your child.
